As you can see from the email from Attorney Bruce M. Beals. Richard G. Prantil was responsible for sending all outstanding bills to me. Richard G. Prantil never sent any bills to me. He just wanted to increase my fees with Mr. Beals.

Mr. Dorner:

Thank you for your email. Due to the fact that I was appointed by the court to be the Discovery Referee in your case, all correspondence had to be sent to the attorneys. It was their responsibility to send you any outstanding statements (“bill”), even if they were no longer the attorney on the case.

Knowing now that Mr. Prantil did not send you the bill, which was his responsibility even if he was no longer on the case, I will have my staff waive the late charges and interest. I am fine with that. You can call my staff (Pita) to pay by credit card if that is easiest for you.

I am not in the office every day since I am only doing work now as a consultant. In answer to your question, only the Court on its own or by written stipulation of the parties can appoint a Special Master. If there are accounting issues, this is a good route to take since the cost is less than each party having to individually hire a forensic accountant. You would either need to have an agreement from the other side, or ask the Court, to appoint a Special Master. Reach out to the other side first and see whether or not they would agree to such an appointment. If so, have them provide you three (3) names.
